OUR MISSION STATEMENT: Beowawe Justice Court is a court of limited jurisdiction which upholds the public's trust and confidence, while retaining its independence and accountability by dealing with each matter in an equitable and timely manner.

DESCRIPTION: The Justice of the Peace may perform marriage ceremonies anywhere in Nevada but the Court itself has jurisdiction over cases in the northern half of Eureka County. The Court hears civil cases with amounts up to $10,000 (starting January 1, 2005), small claims up to $5,000.00, and landlord/tenant eviction hearings.

The Court also issues Temporary and Extended Protective Orders with hearings. The Court handles citations issued by the Nevada Highway Patrol, the Nevada Division of Wildlife, and Eureka County Sheriff's Office. In addition, the Court issues search warrants and arrest warrants, holds arraignments and trials for misdemeanors, and handles felony and gross misdemeanors cases from the initial arrest through the preliminary hearing stage, including bail setting and probable cause determination. Extradition hearings are held when a defendant is accused or has been convicted of serious crimes in another state.

The Seventh Judicial District Court hears appeals from justice court decisions.

HOURS AND LOCATION: On the corner of Fifth Street and Tenabo in Crescent Valley, 20 miles south of I-80, on SR 306. We are open Monday through Thursday, 6:00 a.m. to 4:30 p.m. We are closed daily from Noon to 12:30 p.m. for lunch.

TRAFFIC CITATIONS: JUVENILES: All juveniles must appear with a parent or guardian.

PAYMENTS: The Court will not accept personal checks. Mailed payments should be in the form of a money order or cashier's check. Cash, in the exact amount, will be accepted over the counter. Credit cards are also accepted over the counter and by telephone.

HOW TO PAY A CITATION: The total bail amount must be paid to the court on or before the court date on the citation. Please follow the PAYMENTS instructions. Signing the back of the citation is not mandatory although it would be appreciated.

HOW TO CONTEST A CITATION: You may contest a citation yourself or you can hire an attorney, licensed to practice in Nevada, to represent you. Call the State Bar Association for a referral, 1-800-789-5747 in Nevada, 1-702-382-0504 outside Nevada. Whether you represent yourself or hire an attorney, the following timetable and guidelines should be observed:
    1. An entry of Not Guilty plea must be received no later than the date and time given on the citation.

    2. Your plea may be entered in person or in writing. If you are representing yourself, a personal appearance is preferred so that you may be informed of your rights. You may fax your plea and then mail the original to the court.

    3. After your plea is filed, a trial date will be set. You must post the total bail amount prior to trial. You will receive a full refund if you are found not guilty or a partial refund if the fine is reduced at trial.

    4. It is your responsibility to make sure the Court has your correct and current address. Please contact the Court if you have any questions.


APPEARANCE BY COMMUNICATION EQUIPMENT:  In accordance with ADKT 424, Rules Governing Appearance by Communication Equipment, Eureka Justice Court and Beowawe Justice Court rules will be as follows:

1.  Appearance will be allowed in civil proceedings except as provided in subsection 4 of Rules Governing Appearance by Communication Equipment.

2.  Court will require at least three judicial days notice in written motion form before a hearing, of the party's intent to appear by communication equipment.
All other parties involved in the proceedings will also need to be notified by written motion at least three judicial days prior to the hearing.

3.  It is at the individual court's discretion to modify the rule. Court may require a personal appearance and will determine on a hearing by hearing basis if the appearance would materially assist in the determination of the proceedings or in the effective management or resolution of the case.

4.  Both courts use AT&T Conference Call for parties to appear by communication equipment. Calls will be initiated by the court and parties will be notified in advance of Conference Call procedures.
