OUR MISSION STATEMENT: Eureka Justice Court's mission is to provide a trustworthy, safe, local judicial system to the individuals and organizations in the Eureka Township. OUR PURPOSE: The purpose of the Eureka Justice Court is to make legal decisions based on Nevada Law for government agencies and public and private entities involving court related matters which include Criminal, Civil, Small Claims, Domestic Violence, Landlord/Tenant actions, and Traffic Violations DESCRIPTION: The Justice Court in the Eureka Township hears and decides civil cases with amounts not to exceed $7,500 and small claims cases with amounts not to exceed $5,000. The Court also issues Temporary and Extended Protective orders with hearings. Other duties of the Justice Court include search warrants, arrest warrants, arraignments and trials for misdemeanors, felony and gross misdemeanors starting with arraignments through the preliminary stage, bail hearings and probable cause, and extradition hearings. Traffic citations cited from Eureka Township law enforcement officers are paid, or heard if the defendant wishes to plea not guilty to the citation, through this court. To make a payment, you may send a cashier's check or money order to the address above or pay by credit card via the phone. To plea not guilty to a traffic citation, you need to send the bail amount along with a letter informing the court that you wish to plea not guilty. The bail money will be held until after your hearing and the court's decision. Any appeals from the Justice Court decisions are made through the Seventh Judicial District Court. APPEARANCE BY COMMUNICATION EQUIPMENT: In accordance with ADKT 424, Rules Governing Appearance by Communication Equipment, Eureka Justice Court and Beowawe Justice Court rules will be as follows: 1. Appearance will be allowed in civil proceedings except as provided in subsection 4 of Rules Governing Appearance by Communication Equipment. 2. Court will require at least three judicial days notice in written motion form before a hearing, of the party's intent to appear by communication equipment. All other parties involved in the proceedings will also need to be notified by written motion at least three judicial days prior to the hearing. 3. It is at the individual court's discretion to modify the rule. Court may require a personal appearance and will determine on a hearing by hearing basis if the appearance would materially assist in the determination of the proceedings or in the effective management or resolution of the case. 4. Both courts use AT&T Conference Call for parties to appear by communication equipment. Calls will be initiated by the court and parties will be notified in advance of Conference Call procedures. |
